XARELTO TRIALS SCHEDULED
Lawsuits against the manufacturers of the blood thinner Xarelto (rivaroxaban), prescribed to treat pulmonary embolism, atrial fibrillation, and deep vein thrombosis among other conditions, continue to progress towards trial. Thousands of plaintiffs have brought claims against Xarelto’s manufacturers after suffering severe adverse bleeding events, including GI bleeds, internal bleeding, and brain bleeds, while taking the drug. Most of the cases throughout the country are consolidated in federal court in the Eastern District of Louisiana.
Initially, forty cases were selected as discovery pool cases. Depositions and written discovery were completed in these cases. Now, the federal judge in charge of the litigation has set dates for the first four trials of the litigation. These four cases are all cases within the judge’s jurisdiction, the 5th Circuit consisting Louisiana, Mississippi, and Texas. The first trial is scheduled to begin on April 24, 2017. Following this, trials are scheduled every month until July 2017. These are the first bellwether trials of the litigation. A bellwether trial is a “test” case tried with the goal of moving the overall litigation towards a resolution. Since this is a complex litigation, each trial could last up to eight weeks before a jury returns a verdict.
In the weeks leading up to the trials, pretrial motions will be filed, and the judge will hear arguments from both plaintiffs and defendants regarding the admissibility of evidence, exhibits, and testimony. Experts and witnesses will be prepared for trial. This preparation will ensure the trial moves as efficiently and smoothly as possible.
SIMILAR CASES AGAINST PRADAXA MANUFACTURERS
A similar litigation against the manufacturers of the blood thinner Pradaxa (dabigatran) is ongoing in Connecticut. The judge in that case has also implemented a bellwether process. Trials will begin in January 2018 and continue with a new trial every six weeks through June 2018. These cases also involve severe adverse bleeding events experienced by individuals while taking Pradaxa.
