A class action lawsuit seeking over $5 million in damages was filed against Nissan North America, Inc. for deceptive and unfair sales practices used to market its 2013-2014 Pathfinder vehicles. Thousands of the affected models were reported to be equipped with defective transmissions, causing vehicles to “shudder” and “judder” as the vehicle jerks violently on acceleration. Nissan Pathfinder Defective Transmission Official Complaint

Filed in the Southern District of Florida, the official complaint against Nissan focused on a few key points:

  • First, that Nissan was aware of the transmission defect;
  • Second, that it continued to sell and market the Pathfinders anyway;
  • Third, that Nissan breached express and implied warranties to consumers by failing to fix the problem.

The plaintiff representing the entire class, Kenai Batista, alleged that upon discovering the transmission issue she asked Nissan to fix the problem, but they could not or would not repair it.

The complaint also claimed that Nissan chose financial gain over the safety of their consumers by concealing knowledge of the transmission defect and continuing to market the Pathfinder to unwitting customers.

The class action sought over $5 million in damages, injunctive and declaratory relief, and punitive damages for its alleged deceptive and unfair trade practices, and alleged breach of express and implied warranties, which violates the Magnuson-Moss Warranty Act and Florida common law.
